Trucking Industry Combats New Port Regulations

The American Trucking Associations (ATA) filed a lawsuit in federal court on July 28, claiming new regulations imposed by the Ports of Los Angeles and Long Beach violate the Commerce Clause of the U.S. Constitution. The proposed regulations seek to cut nitrogen oxide by 45 percent, particulate matter by 47 percent and sulfur oxides by 52 percent. Trucks servicing the port must comply with the new restrictions by Oct. 1 or face being barred from the ports. In citing the Commerce Clause, the ATA claims the regulations illegally regulate prices, routes and services by favoring large companies over independent truckers.
