Surface Transportation Board Orders
CSX Railroad to Provide Rate Relief


The Surface Transportation Board (STB) recently announced its unanimous decision ordering CSX Railroad to provide rate relief to E.I. du Pont de Nemours and Co. DuPont sought rate relief under the STB’s new small rate dispute resolution process.

In its ruling, the STB concluded that CSX had charged “unreasonably high rates” and ordered the railroad to both reduce rates – from 5 percent to 40 percent of the challenged rates – and pay reparations on six of the seven disputed moves. DuPont is expected to realize up to $3 million in benefits between the reduced rates and the reparations.

The Surface Transportation Board is the federal government agency charged with overseeing railroad rate and service disputes and reviewing railroad mergers. The organization is governed by a three-member board – appointed by the president and confirmed by the Senate – each with a five-year term of office.
